After the tragic September 11th attacks, the Transportation Security Administration (TSA) was established. It was put in place to protect individuals when traveling. For many young people, they don’t know of a world before traveling unmolested was simply a way oflife.
The TSA has checkpoints, bag checks, and body scans for safety reasons. They “suspend” one’s liberties at the checkpoints to ensure the safe travel of Americans, but this is problematic.
When the founders wrote the Constitution they had a certain set of ideas in mind, among these was an expectation of privacy. As the British routinely searched and seized other individuals property, the fathers felt this is a violation of a human's natural-born rights.
And so the Fourth Amendment of the Constitution was included in the Bill of Rights. The Fourth Amendment reads:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
It’s clear, even self-evident, that the TSA has no regard for the Fourth Amendment.But, the opposition to this argument is always safety. Though that is a valid assessment, there are many flaws with the argument’s logic.
First, the freedom of individuals is prioritized over safety in the U.S. Constitution. The fathers would say it’s far more important to have the citizenry travel freely, and have privacy than to have the government to search private property.
“Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.” Benjamin Franklin said about the creation of the Fourth Amendment.
Second, in the TSA’s entire history zero terrorist have been caught by the TSA. That’s no exaggeration, not a single terrorist have ever been caught under the TSA’s authority.
Third, and perhaps most interesting, was the TSA failed 95% of mock threat test; resulting in the TSA’s director to resign. This summer Homeland Security tested the TSA's ability to detect terrorists threats. In 67 out of 70 tests, Homeland Security succeeded in smuggling either explosives or firearms by TSA agents.If a college student failed 95% of the exams they took, he/she’d be kicked out of their university.
So, why does the TSA still exist? Are they members of a police state, looking to infringe on the most basic liberties?
Never consent to an unwarranted search of your belongings. No one, not even the TSA has the authority to do as such.
