News about Kesha’s trial is everywhere these days and for good reason. Something that really scares me about society today is how easy it is for predators to get away with their crimes. I read a tweet the other day that said the following:
“Chris Brown can beat his girlfriend and still have a successful music career but Kesha is forced to keep her recording contract with the man who raped her.”
This speaks volumes to the injustice in society currently. Kesha just wants to make music and be able to work through the horrible events she endured without having to see her assaulter everyday. No matter what the contract states, no judge should decide that a woman has to work with the man who assaulted her because her “sexual assault allegations aren’t enough to free her from her contract.”
A judge’s duty to our country is to make sure justice prevails. Justice Shirley Kornreich should not be able to serve another day if she can not only reject Kesha’s request for an injunction but also state that her instinct “is to do the commercially reasonable thing”. She should not be able to defend our constitution and every citizens rights. The commercially reasonable thing? I think rape is enough to break whatever legal bind this contract holds.
Why is it so easy for people to say that this is a legal issue and that’s why her release can’t be granted? It’s hard enough for her to have to live through this and be in the public eye during the trial. It’s a human rights issue. This isn’t just about Kesha’s trial. This is about all victims of sexual assault that aren’t able to get a fair trial or even a trial at all because people claim “there isn’t enough supporting evidence” or “the claim of assault won’t stand in trial” or “it’s his word against hers.” This cannot be the case anymore. Our society needs to change. Protecting the innocent is very important but so is protecting the victim. We need to start caring more for the victim whether it be a woman or a man. They deserve our attention.
A recording contract should not be more legally valid than human rights. This case is disgraceful and everyone involved that has sided with the guilty party is despicable. I hope Kesha is freed from her contract and is able to find the happiness she deserves. As for the guilty party, I don't have anything nice to say so I won't be saying anything at all.
