Kesha’s court case has been widely publicized but has also grown more and more complex. First, it is important to know exactly what she accused her producer, Dr. Luke, for.
Allegedly, Dr. Luke induced Kesha to drop out of her high school in Nashville, Tennessee and leave her life behind when she was 18 years old. Kesha says that the date rape for which she has accused him occurred at a birthday party for Nicky Hilton, where Dr. Luke gave her a drug that caused her to black out. She woke up naked in her producer’s hotel bed and could immediately tell she had been assaulted; she was a virgin before the date rape.
The lawsuit reports that "Ms. Sebert took the pills and woke up the following afternoon, naked in Dr. Luke's bed, sore and sick, with no memory of how she got there. Ms. Sebert immediately called her mother and made a 'fresh complaint,' telling her that she was naked in Dr. Luke's hotel room, she did not know where the clothes were, that Dr. Luke had raped her and that she needed to go to the emergency room."
The story never came out, though, because according to the lawsuit Dr. Luke aggressively threatened Kesha, “screaming and violently thrashing his arms at her…He physically backed Ms. Sebert into a corner, where she curled up into a ball, crying and fearing for her life.”
This was only the beginning of Dr. Luke’s physical and emotional abuse of the young singer. He allegedly forced her to snort illegal substances and to take “sober pills,” which Kesha claims were, in reality, a form of gamma-hydroxybutyrate, what most people know as the date rape drug. Dr. Luke made sure she was most often on some form of drugs or alcohol, and once “forced himself” on her after giving her an illicit substance to snort before boarding a plane. In addition, she claims he once bodily attacked her at his Malibu house, after which she fled shoeless down a coastal highway strewn with shattered glass.
Perhaps what was more detrimental to Kesha’s wellbeing was Dr. Luke’s purported emotional abuse. She says he bragged about how he liked to get girls drunk and have sex with them, and about how he blackmailed his pregnant wife into getting an abortion by refusing to speak to her for six months and threatening to terminate their relationship.
He told her these stories to make her fear him, and it worked. He threatened to ruin her and her family if she told the truth while simultaneously forcing her to live with long-term, inescapable, one-sided contracts. These contracts have denied her “any meaningful profit from her work.” He refused to renegotiate her contract and constantly insulted her looks and talent in an attempt to foster her self-loathing and keep her, insecure, under his thumb. Dr. Luke also forced himself into the role of executive producer on Kesha’s reality TV show, ensuring she was virtually never out of his sight.
Kesha’s silence was insured by Dr. Luke’s constant manipulation of her fear; he allegedly warned her that “strike one” was when she hired an unapproved manager and “strike two” was when she refused to record her second album when he wished. He also regularly criticized Kesha’s weight, telling her to stop eating and calling her a “fat f***ing refrigerator.” As a result, Kesha suffered from depression and bulimia nervosa so intense she had to enter rehab in January.
“I was too young and naïve to even understand what he was doing to me,” Kesha says.
Lastly, Kesha claims her producer used her for the money she would bring him, once threatening to have her dog put down if she didn’t “Go finish the song so I can buy a yacht.”
Kesha has since filed a lawsuit against Dr. Luke. The official complaints are as follows: 1) sexual assault and battery, 2) sexual harassment, 3) gender violence, 4) civil harassment, 5) violation of California’s unfair business laws, 6) intentional infliction of emotional distress, 7) negligent infliction of emotional distress, 8) negligent retention and supervision. She is suing for punitive damages and seeks an escape from her exclusive recording contract, which requires her to record six more albums for Sony Records.
Kesha was too scared to go to the police following the alleged date rape, but she did eventually report the crime to doctors. A source has said that there are medical records but has not elaborated. Kesha’s doctors who helped her in rehab asserted that ongoing contact with Dr. Luke would be “life threatening.”
“The facts presented in our lawsuit paint a picture of a man who is controlling and willing to commit horrible acts of abuse in an attempt to intimidate an impressionable, talented, young female artist into submission for his personal gain,” her lawyer Mark Geragos said.
Kesha’s case, though, has been weakened by the fact that she once denied having ever suffered abuse at the hands of Dr. Luke while under oath in a previous court case. In that case, she and Dr. Luke were being sued by a management firm they’d fired. She testified, “Luke never made sexual advances at me.” She now claims she lied for fear of her own well-being.
She says of her most recent case, "All I ever wanted was to be able to make music without being afraid, scared, or abused. This case has never been about a renegotiation of my record contract – it was never about getting a bigger, or a better deal. This is about being free from my abuser. I would be willing to work with Sony if they do the right thing and break all ties that bind me to my abuser."
Dr. Luke, whose real name is Luke Gottwald, has not been charged with any crime and denies the allegation through his lawyer. He filed a countersuit, but it was dismissed.
“Kesha’s lawsuit is a spectacular and outrageous fiction that will go down in flames. As the truth emerges, this sad and misguided smear campaign will only hurt Kesha,” Dr. Luke’s lawyer Christine Lepera said in a statement to The News.
Lepera said the claims were part of an “extortionist scheme” devised to ruin Dr. Luke’s (full name: Luke Gottwald) reputation because he has not released Kesha from her contract. “Luke hasn’t seen Kesha in years. This kind of cynical grandstanding in which false claims of abuse are used as a negotiating tactic insults real victims,” Lepera said.
“Extortion is not going to win here,” she said, claiming that court records in another unidentified case contain “evidence of (Kesha’s) lie…We are confident that Dr. Luke will prevail in all matters, and that our client will be awarded substantial damages for this malicious conduct.”
"As set forth in the complaint that we have filed on behalf of Dr. Luke, Kesha, and her mother are engaged in a campaign of publishing outrageous and untrue statements about Dr. Luke to third parties, including scurrilous and false statements of purported physical and mental abuse of Kesha. These are allegations that Kesha and Pebe have themselves admitted are false. The complaint explains that Kesha and her mother Pebe have wielded these defamatory statements in an attempt to extort Gottwald into releasing Kesha from her exclusive recording agreement with Dr. Luke.”
“Undoubtedly, Kesha’s lawsuit is nothing more than a continuation of her bad and offensive acts,” Lepera previously said. This brings up another interesting aspect, or one might even argue bias, of the case. In several articles about the case, Kesha’s reputation as a bad role model, and her risky behavior that has been documented by the media is referenced. But that begs the question: what is the relevance? Does her media persona in any way control who does or does not abuse her?
Kesha burst into tears, captured in heart-wrenching photos after the verdict was released that she would not be released from her contract and would be forced to continue working for and with her abuser and his label, Kemosabe Records. The Manhattan Supreme Court judge said that granting Kesha’s request would undermine the state’s laws governing contracts. The court could not do that. Sony has offered to let the young singer work with another producer, but Kesha fears the company won’t promote her music as heavily if she no longer works for Dr. Luke. Kesha’s lawyer, Mark Geragos, quarreled that Sony’s promise regarding a different producer was “illusory” because the recordings would not be promoted by the company, and said that Sony has greater investments in Dr. Luke, their biggest hit maker, than in Kesha. Sony would protect Dr. Luke above all else because he provides them with more monetary benefits.
Following the verdict, twitter exploded with the hashtags #FreeKesha and #IstandwithKesha. Thousands of Kesha’s fans and supporters signed a petition calling for a boycott of Sony music.
