21-year old Deandre Somerville of Palm Beach, Florida missed a civil trial last month. He had woken up at 11:30 am and realizing that he had missed a part of the case, he decided to go to work instead. Somerville did not understand the consequences that him oversleeping would make. What should've been treated as a careless mistake escalated into something so much worse.
Judge John S. Kastrenakes, a civil court judge sentenced Somerville to 10 days in jail, a year of probation, 150 hours of community service, $223 in court costs and ordered him to write a letter of apology to the court.
Somerville, who had no prior criminal record, was now sentenced to ten days in jail last week. He reported to WPTV that "After going through that, my life will never be the same again."On Friday, a remorseful Somerville appeared before Kastrenakes again to formally apologize while appealing his conviction for contempt of court. At first, Kastrenakes agreed to reduce Somerville's remaining sentence to three months of probation and 30 hours of community service. The judge then decided that to take off the criminal record off of Somerville's record and rescind the remainder of his punishment.
Although Judge Kastrenakes had a change of heart and was able to strike the 10 day jail stint off of Somerville's record, his initial ruling was widely viewed as excessive. Keep in mind that DeAndre was sent to jail for literally oversleeping.
I believe that the punishment should fit the crime and in this case, it really didn't. I understand that jury duty is important, but it's not worth going to jail over. I'm glad that the judge wiped his record clean, but that doesn't change the fact that Somerville still had to go jail.
