The death penalty has been around since Babylon and has always caused controversy. Throughout the years the use of the Death Penalty especially in the United States has begun to slow down many states still have the Death Penalty as an option for punishment. There are not too many people in the world that would say they are not afraid of a Life Sentence for committing a crime, But when we hear the Death Penalty as the outcome of sentencing, it creates a very distinct realization for that person.
The Death Penalty is very different from what it was when it arrived in the United States in 1608. As of 2017, there are only 31 states that still carry out death sentences. Some States do not carry the Death Penalty, but there are still ways to be sentenced with it especially when it comes to acts of terrorism, the system does not tolerate Terrorism as it demonstrates hate crimes and the intent to harm others.
For Example, The Boston Bomber, Dzhokhar Tsarnaev was sentenced to death even though Massachusetts is not a "Death Penalty State." Dzhokhar and his brother planted bombs near the finish line during the Boston Marathon killing many and injuring a lot more. After a manhunt that leads to his brother being killed and the death of an MIT police officer Dzhokhar was captured. He was charged with more than 25 charges. Many of them fall under the criteria of being sentenced to death.
For Example, he was charged with Conspiring to use a Weapon Of Mass Destruction, the use of a Weapon Of Mass Destruction resulting in the Deaths of the innocent, Conspiracy to bomb a public place, among many of the 17 charges that would sentence him to death. Seeing how Massachusetts does not have the death penalty in effect, the Judge had to select a state that would carry it out. Because of the lack of remorse and brutality of the crimes, there had to be a further punishment rather than spending the rest of his life in a Massachusetts Prison. He committed unthinkable acts of terrorism that were Federal crimes, and the Court system handled it in a matter that either way he would receive death one way or another even if it were in another state.
Thought it seems as if being put to Death is a cruel and unusual punishment it has been around for years and years. Depending on which side of the fence you are on, it is either looked at as the necessary or unnecessary punishment to the disgusting crimes that happen throughout this country and world.
The Evolution of the Death Penalty is a delicate one. Many factors are brought into play as it has evolved over the history of this country including the cases that helped shape the constitutional rights of the defendants on Death Row, also how the Death Sentences are dealt with today in 2018.
There are times when the DP is constitutional and not Manslaughter, for example, does not meet the criteria because there is no planning or intent to kill someone. People across the country get charged with manslaughter all the time for killing someone while they were drinking and driving. There are times when the death penalty is a constitutional move, such as cases of murder because the intent was premeditated murder.
It was something that was planned like in the case of the vicious Ted Bundy; he had full intentions of killing his victims during the time he was committing the crime as heinous as they were. The death penalty has had a long history in the U.S., and it will continue to do so in the future. But where do you stand with it?
