Yes, this is yet another article on the Brock Turner sexual assault case. Your Facebook feed is clogged with it, articles informing what happened, the outrage over the lack of justice in this case, the stupid comment his father made on his behalf, etc.

What makes me upset about this case, besides the obvious actions of the rapist, is the ruling and the judges verdict.

Turner was charged with three felony counts: Penetration of an intoxicated person, penetration of an unconscious person, and assault with the intent to commit rape of an intoxicated/unconscious person.

With those charges Turner should have been sentenced to fourteen years in state prison, however he was sentenced to six months in county jail, but will only serve three months in jail because of good behavior. The extent to how plush Turner's sentence is- it allows him to have a cell phone.

The judge behind this sentencing is Judge Aaron Persky. Persky is a Stanford and UC Berkley Alumni. While at Stanford Judge Persky was captain of the lacrosse team. To say that Judge Persky has a 'soft spot' for fellow student athletes is an understatement.

It's no secret to anyone who has peeked at Brock Turner's case knows that Judge Persky sympathizes with Turner because Turner was a member of the Stanford swim team prior to the sexual assault.

This isn't the first time Judge Persky has helped in favor of college athletes when they are faced with sexual assault allegations. The first time was almost a decade ago.

In March of 2007 at De Anza College, only twelve miles away from Stanford, eight baseball players for De Anza College had been accused of sexually assaulting an intoxicated seventeen year old girl. Three members of the womens' soccer team reported the assault saying at least two or more people had sexually assaulted her.

When they found the seventeen year old, she was unconscious and covered in vomit, the three soccer players called it, "clearly not consensual." They also stated that there had been a number of people in the room witnessing the assault and were even cheering.

The victim of the assault did not win her case.

While on trial, De Anza student athlete, Christopher Knopf became one of the last defendants for this case because he was the first man to enter the room with the victim. Knopf's lawyer had found pictures of the victim on Facebook in "scantily clad" clothing.

Judge Persky had the case and allowed for the defendant's lawyer to show the jury eight pictures of this girl.

Because of the pictures Judge Persky allowed, the trial fell in favor of the defendants finding them not guilty. They reasoned that because of how the girl was dressed she probably invited Christopher Knopf into the room with her.

According to Mercury News, one of the jurors even said, "She came there kind of looking for it."

Judge Persky is the reason why 2 out of 3 rapes go unreported. Because their assailant will walk free with a slap on the wrist, because their character will be challenged, because they will be questioned on if they actually wanted it at the time, and because their choice in clothing will be the final judge on wither they were actually raped or not.

Judges like Aaron Persky are biased and don't care about the physical and emotional state of the victims.

Many people who grow up in small towns find themselves counting the days until they get to escape their roots and plant new ones in bigger, "better" places. And that's fine.
